If I had discovered this as part of an EICR I would recommend it as a C2 and recommend that the socket was rewired correctly.
Maybe C1 depending on the condition of the wiring installation, especially if it's a DIY job.

I'd like to add that it's very useful to have many of the electrical manufacturer's torque screwdriver settings all listed in one place. I wonder if this data will be acceptable as it is given by a 3rd party ie. the torque screwdriver manufacturer ****. Also this data could be subject to change...
I agree that downlights with insulation are a nightmare but LEDs are the way to go. Definately time the 1st fix to avoid the building inspector.
7 watt LEDs create hardly any heat and prices and specs will improve quickly as the manufs compete.
At least something is getting better!
